Read the terms and conditions for Kew's Tweet & Grow game.

These Terms and Conditions govern your use of the Tweet & Grow game which shall apply whether you are a guest or a registered user. Please read them carefully as they affect your rights and liabilities under the law.

Use of the Tweet & Grow game is subject to the following Terms and Conditions and your use of the Tweet & Grow game is deemed to confirm your acceptance of these Terms and Conditions, the Website Terms and Conditions and the Privacy Policy, as applicable.

Definitions contained in the Website Terms and Conditions shall apply to these Terms and Conditions unless stated otherwise below.

If you register with the Tweet & Grow game for a user account then you will have to supply a valid email address. You will be responsible for keeping your username and password secret and for preventing unauthorised access to your account. You are responsible for all activities that occur using your account. You should take all necessary steps to ensure that your username and password are kept secret and secure, and should inform us immediately by email to tweetandgrow@kew.org if you have any reason to believe that your username and/or password have become known to anyone else, or if your account is being, or is likely to be, used in an unauthorised manner.

You must ensure that the details you provide us with are correct, complete and not inappropriate in any way. You agree to inform us immediately of any changes to the information that you provided when registering. You can update the information you provided us by emailing us at tweetandgrow@kew.org.

We may change these Terms and Conditions and/or the Privacy Policy at any time and your continued use of the Tweet & Grow game after any such changes are made confirms your agreement to those varied terms. We reserve the right to make changes to, suspend or discontinue part or all of the Tweet & Grow game, the content, services or products available through it. We shall not be liable if for any reason the Tweet & Grown game or any part thereof is not available for any period or at any time.

Whilst we have taken all reasonable efforts to ensure that information provided is correct, the information provided on the Tweet & Grow game is intended to be used for information purposes only and should not be relied upon for any legal, financial or personal reason whatsoever. The Trustees of the Royal Botanic Gardens, Kew shall have no responsibility for any information not provided on the Tweet & Grow game.

If you breach any of the terms of these Terms and Conditions, the Website Terms and Conditions or the Privacy Policy, your permission to use the Tweet & Grow game automatically terminates.

We and our respective partners, officers, members, employees and advisers shall not be liable for any direct or indirect or consequential loss or damage, nor for any loss of revenue, profit, business, data, goodwill or anticipated savings suffered by any person as a result of reliance on a statement or omission on, or the use of, the Tweet & Grow game.

Your use of the game

You may only use this game for lawful purposes in accordance with these Terms and Conditions, our Website Terms and Conditions and our Privacy Policy.

You must not do anything which may infringe the rights of a third party, or restrict or prevent the use of the game by a third party. For example, you must not: engage in conduct which is unlawful or which may harass, distress or inconvenience any person; transmit obscene or offensive content; or do anything which may disrupt the normal flow of dialogue within the Tweet & Grow game. Where the Tweet & Grow game contains links to third party websites and resources, these links are provided for your information only. We have no control over the content of these sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them. The inclusion of a link to a third party website does not constitute an endorsement of that third party’s website, product or services (if applicable).

Your Tweets

You are responsible for your use of the Tweet & Grow game and for any content you post to the Tweet & Grow game ("Content"), and for any consequences thereof. The Content you submit, post or display in the Tweet & Grow game may be viewed by other users of the Tweet & Grow game and through third party services and websites. You may vary what content is submitted by going to the Tweet Settings screen. You should only provide Content that you are comfortable sharing with others under these Terms and Conditions.

Remember that everything you post on Twitter can be read all around the world instantly and the Twitter Terms of Service contain restrictions on the content you may upload.
We reserve the absolute right at all times (but will not have an obligation) to remove or refuse to distribute any Content on the Tweet & Grow game and to terminate users or reclaim usernames at our absolute discretion.

Ownership of Content

Ownership of all intellectual property rights in the Tweet & Grow game are owned and retained by the Board of Trustees of the Royal Botanic Gardens, Kew who are the owner or the licensee of all intellectual property rights in the Tweet & Grow game including the design, logos, graphics, icons, images and publications on the Tweet & Grow game and content which is published by us on it or contained in it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

Nothing in these Terms and Conditions shall be construed as conferring in any way (express or implied) any licence or right to use any intellectual property that belongs to us or any third party except where expressly permitted.

You retain ownership of Content, however, by submitting, posting or displaying such Content on or through the Tweet & Grow game, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods (now known or later developed).

Disclaimer

You accept that the Tweet & Grow game is provided on an 'as is' basis. Accordingly, to the maximum extent permitted by law, We provide the Tweet & Grow game on the basis that we exclude all representations, warranties, either express or implied, and other terms which, but for this disclaimer, might have applied.

Your use of the discount vouchers

Discounts can be won during game play where a unique discount voucher will be available to download from the game.

2 for 1 Entry to Kew Gardens

This voucher admits one person free of charge when accompanied by one full paying adult. Children under 17 accompanied by an adult are free of charge. Proof of age may be required. There can only be one free person per voucher. The offer is valid until 25 September 2011 . This voucher cannot be used in conjunction with any other offer. Photocopies are not acceptable. This voucher has no cash value. Vouchers must be surrendered at one of the entry gates. Kew Gardens reserves the right to refuse entry. 2 for 1 Adult Kew Explorer Land Train tickets

This voucher entitles the bearer to one additional free Adult Kew Explorer land train ticket when one Adult Kew Explorer ticket is purchased. This offer applies to Adult Kew Explorer tickets only (required for passengers aged 17 and over). There can only be one free person per voucher. This voucher must be exchanged at any one of the Ticket Gates. It cannot be used when purchasing a ticket from the Kew Explorer Driver or Kew’s shops.

Online discounts

To redeem your discounts online from http://shop.kew.org, all codes must be entered exactly as you have received it because the system is case sensitive. All codes must be entered at the point when viewing your basket before proceeding to the checkout. All offers are available until 1 October 2011.

Shops at Kew Gardens

The voucher must be presented at the till at the time of purchase, before payment has been taken and must be handed over to the Retail staff member. The voucher cannot be applied after payment has been taken. There can only be one voucher per transaction. The voucher cannot be used in conjunction with any other offer, such as the ‘Friends membership discount’. The voucher applies only to full-price items. The voucher is not valid for mail order purchases. The voucher is only valid until the date of expiry. Photocopies will not be accepted.

Cafés at Kew Gardens

The voucher offer is subject to availability. We reserve the right to withdraw or substitute the offer at any time. Only one offer can be redeemed per voucher. Each voucher cannot be used in conjunction with any other offer. To redeem the offer you must present your phone or printout, with the code, to the relevant Kew restaurant or café.

Trademarks

The game includes registered trademarks which are protected by law including, but not limited to, the Kew logo. You may not use these trademarks without our prior written consent. Ownership of intellectual property rights in the Tweet & Grow game is subject to our Website Terms and Conditions where, for the purposes of these Terms and Conditions, the definition of Website is deemed to include the Tweet & Grow game.

If these terms are unenforceable

If any of these terms are determined by a court to be illegal, invalid or otherwise unenforceable, these terms will still apply, but the provision which was held to be invalid, illegal or otherwise unenforceable will no longer have effect.

Privacy Policy and use of your data

Our Privacy Policy contains statements relating to our use of your data which we may collect through our Website or through the Tweet & Grow game. It is not intended to form a binding contract and may be changed at any time by the Board of Trustees of the Royal Botanic Gardens, Kew.

The security of your personal data is of upmost importance to us. We will only use your data as supplied to the Tweet & Grow game in accordance with our Privacy Policy, as amended from time to time. For the purposes of these Terms and Conditions, the definition of 'Website' in our Privacy Policy is deemed to incorporate the Tweet & Grow game and shall apply accordingly.
