Terms & Conditions
1. By sharing your photograph with the Moore at Kew Flickr Group, you agree to these Terms & Conditions.
2. Before sharing your photos with the Moore at Kew Flickr Group, please read these Terms carefully. They contain standards which you must comply with, and important information about what rights the Royal Botanic Gardens, Kew ("Kew") will have to use your photographs.
3. By sharing your photos with the Moore at Kew Flickr Group, in respect of each photograph you confirm that:
- it was taken by you;
- it is your own original work;
- sharing it with the Moore at Kew Flickr Group and granting a licence in respect of its use as set out in these Terms will not infringe the copyright or any other rights of any third party; and
- it does not contain any obscene or defamatory content or material.
4. By sharing your photos with the Moore at Kew Flickr Group, in respect of each photograph you grant to Kew a non-exclusive, worldwide, royalty-free, licence to display your photo (as it is stored on Flickr) on Kew's website and/or from Kew's server (including in a live gallery) where such display is connected with the Moore at Kew Exhibition. This licence shall apply for the period during which the photo is posted in the Moore at Kew Flickr Group. If you remove your photo from the Moore at Kew Flickr Group, this licence will automatically terminate. If your photo is displayed on Kew’s website and/or from Kew’s server (for example in a live gallery), your Flickr screen name and the title of the picture will appear with the photo.
5. If Kew wishes to use any of your photos in any other way, for example:
- by displaying your photos on electronic screens on-site at Kew;
- by publishing your photos in Kew-published magazines (for example the Kew Magazine) and other materials;
- by archiving your photos (please be aware that Kew intends to maintain a website relating to the Moore at Kew Exhibition after the close of the Exhibition itself); or
- by making copies of your photos and/or downloading the high resolution version as may be required for any specified purpose,
or for any period longer than the period during which your photos are posted in the Moore at Kew Flickr Group, we will contact you via Flickrmail to obtain your express approval of such use(s) of your photos. Should Kew wish to display your photo on an electronic screen on-site at Kew and/or publish your photo in a Kew-published magazine or other material and/or archive your photo and you grant your approval of such use(s), when granting us the approval please state your name as you would like it to appear with your photo (otherwise, Kew will use simply use your Flickr screen name).
6. To be clear, unless Kew has contacted you and obtained your express approval, Kew will only use your photo(s) by displaying it on Kew’s website and/or from Kew’s server (including in a live gallery) where such display is connected with the Moore at Kew Exhibition.
7. Kew shall not be obliged to display your photographs and shall not have any liability to you for any loss of publicity or enhancement of reputation.
8. Kew reserves the right to cancel the Moore at Kew Flickr Group and the Moore at Kew Photo project at any time.
9. Your personal information will only be used and, where necessary, disclosed to third parties for the purposes of running the showcase and otherwise in accordance with the Kew online Privacy Statement.
10. You are reminded that it is a term of entry to the Moore at Kew Exhibition that photography at Kew is permitted for non-commercial purposes only.
11. By entering your photo to the Moore at Kew Flickr Group, you are deemed to have accepted these Terms.
